BOOKING FEES / CANCELLATIONS / RESCHEDULING / TARDINESS

BOOKING FEES : 75% of your package price is required upfront to reserve your date for all regularly priced sessions and 100% is due upfront for all discounted sessions. This is NON-REFUNDABLE. No exceptions.
CANCELLATIONS : A 72hr written (text) cancellation or reschedule request is required to avoid a cancellation fee, please text to 909-255-9328. If you no call no show, you are forfeiting your booking fee and we will not schedule with you again. Please be mindful that when we block off a time spot for you, we are holding that spot for only you. Therefore, we are not able to schedule someone else. We will not tolerate no call no show clients.
RESCHEDULING : We understand that life happens. People get sick, and things go wrong. If you need to reschedule for any reason, please try to give us 72 hrs notice. If you happen to fall ill the day of your session, please reschedule. A 72hr written (text) reschedule request is required to avoid a cancellation fee, please text to 909-255-9328. We work every day with all age groups and cannot risk passing on anything to our beloved clients. Your photos will look better if you are feeling well rested and at your best! If it is down pouring and sideways rain that hinders our photo session, we can without a doubt reschedule. If your reschedule is approved, your booking fee will carry over onto your new date.
TARDINESS : Please plan enough time to get to your session. Whether that be getting the kids ready or navigating through rush hour traffic. If you are running late, please call us. We respect every single client's time and put an incredible amount of effort into scheduling and planning a session, so please respect ours. If you have a 60 minute session scheduled and you are 20 minutes late, you will then have a 40 minute session. If time allows, and you would like your full session, a $30 late fee will be added to your balance if you are over 15 minutes late. If you are more than 30 minutes late without calling, you will forfeit your booking fee and we will have the right to cancel the session. We of course understand unforeseen circumstances such as illness or accidents. If we are late, we will communicate that with you and your session time will not be affected.

TURN AROUND: I have a 10-14 business day (Tuesday-Saturday) turn around period. Anything faster than that requires clients to purchase expedited editing services. $50 for 7 days. $100 for 3 days.
CLIENT'S USE OF PHOTOGRAPHS:  Client may use the photographs taken pursuant to this Agreement for personal, non-commercial purposes, including display on personal websites and copies for family and friends, if, when customary, credit is given to Photographer as "©YourFavoritographer" on instagram or "Marian Gbaiwon Productions" anywhere else. Client agrees to not permit or assist with any commercial use or sale of the photographs without specific written consent of Photographer.
MODEL RELEASE: Client grants Photographer and Photographer's heirs, legal representatives, and assigns the irrevocable, perpetual, and unrestricted right to use the photographs taken pursuant to this Agreement in all forms, media and manners, in conjunction with Client's own or a fictitious name, for advertising, trade, promotion, exhibition, or any other lawful purposes. Client now and in the future waives any right to review or approve: the photographs themselves, the use of the photographs, or the matter that may be used in conjunction with the photographs. Client waives any right to royalties or other compensation arising from or related to the use of the photographs. Client releases, discharges, and agrees to hold harmless Photographer and Photographer's heirs, legal representatives, and assigns from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in the taking, processing, or publication of the photographs.
Copyright  Copyright and ownership of images taken by Our Treats Designs ( Marian Gbaiwon Productions MGP) Photography will always be retained by Marian Hills. Unless given written authorization, the client is forbidden by law from copying any images created by Marian Gbaiwon Productions and agrees that all photographic reprints, digital duplications or copies of any type made from images created by MGP shall only be carried out by MGP.
The images may not be reproduced, printed, copied, transmitted or manipulated without the written permission of Marian Hills. The use of any image as the basis for another photographic concept, illustration or reproduction (digital, artist rendered or alike) is a violation of the law and is strictly prohibited. The license to reproduce such images is granted to the client on the understanding that all invoices are paid within the MGP stated payment terms.
BUSINESS/BRAND OWNERS: You are free to use the images for your business, including paid promotions, advertisements, flyers, etc. You can use  the images for all of your personal business/brand related purposes.
Reproduction rights (if and when granted) are strictly limited to the use specified on the invoice. An agreement must be reached with MGP before the pictures are used for a different purpose or after the license has expired. MGP reserves the right to charge an additional fee if the photographs are used for purposes other than what is shown on the invoice.
All original digital files created by MGP remain the property of Marian Hills. MGP will ensure that all such materials are stored safely for the client and make them available for future reproduction in return for the relevant fee.
MGP reserves the right to make reproductions of images created during assignments for marketing, promotional, competition and editorial purposes. MGP reserves the right to use images from events, permitting the subject captured does not object under accordance with the law.
Fees and Expenses All prices quoted to the client apply only to the original job description and specifications given to MGP by the client. MGP reserves the right to make additional charges for fees and expenses should these descriptions or specifications differ or change before or during the assignment.
Retainers: Retainers are due at the time of booking. No sessions will be secure without a retainer. If we discuss a date for your session via email or any other form of communication that date is not confirmed without a deposit. Retainers are non-refundable.
